These Terms of Use ("Terms") govern your use of sunrisefinace.com ("the Site") operated by sunrisefinace.com. By accessing the Site or submitting a loan request, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, a legal resident of the United States, and not a resident of a state in which our service is not available, to use the Site. See Lending Policy for the current state availability list.
2. Nature of the service
sunrisefinace.com is a loan request and lead-generation service. We are not a lender, not a loan broker, and not an agent or representative of any lender. We do not make credit decisions, set rates, or fund loans. We transmit your request to one or more participating lenders for their consideration.
3. Accurate information
You agree that all information you submit through the loan request form is true, accurate, and complete to the best of your knowledge. Submitting false information may constitute fraud and may result in denial of your request and referral to law enforcement.
4. No guarantee of approval
Submitting a loan request does not guarantee that you will be matched with a lender or that any lender will approve your request. Loan amounts, interest rates, fees, repayment terms, and funding timing are determined solely by the lender.
5. Communications and consent
By using the Site you agree to the Privacy Policy and the E-Consent. By checking the consent boxes on the form, you separately agree to the TCPA consent for marketing and account-servicing contact, the credit authorization, and electronic delivery of disclosures.
6. Intellectual property
The Site and its content, including text, graphics, logos, and software, are the property of sunrisefinace.com or its licensors and are protected by United States copyright and trademark law. You may not reproduce, distribute, or create derivative works from the Site without our written permission.
7. Prohibited conduct
You agree not to (a) use the Site for any unlawful purpose, (b) attempt to gain unauthorized access to any portion of the Site, (c) submit information about anyone other than yourself without their authorization, (d) use any automated means to access the Site, (e) interfere with the operation of the Site, or (f) violate any applicable law in connection with your use of the Site.
8. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUNRISEFINACE.COM, ITS AFFILIATES, AND ITS LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY LOAN OFFER OR LOAN PROVIDED BY ANY LENDER.
10. Indemnification
You agree to indemnify and hold sunrisefinace.com and its affiliates harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your submission of inaccurate information, or your violation of any applicable law.
11. Governing law and dispute resolution
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles. Nothing in this section waives any unwaivable right under the federal Fair Credit Reporting Act, the Truth in Lending Act, or applicable state consumer-protection law.
12. Binding individual arbitration; class action waiver
PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS. Except for the carve-outs listed below, you and sunrisefinace.com agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any communications or services provided to you (each a "Dispute") will be resolved exclusively by final and binding individual arbitration rather than in court.
Arbitration administrator and rules. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. The arbitrator's award will be final and may be entered as a judgment in any court of competent jurisdiction. The arbitration will take place by phone, video, or in writing whenever possible; in-person hearings, if any, will be held in your county of residence or another mutually agreed location.
Class-action waiver. You and sunrisefinace.com agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Carve-outs. Either party may bring an individual claim in small-claims court for any dispute within the jurisdictional limit of that court, and either party may seek injunctive or other equitable relief in court to protect intellectual-property rights. Nothing in this Section limits your right to file a complaint with a governmental agency or to participate in any government investigation.
30-day opt out. You may opt out of this arbitration agreement by emailing info@sunrisefinace.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Your email must include your full name, address, and a statement that you wish to opt out. Opting out will not affect any other terms of this agreement.
Severability. If the class-action waiver is found unenforceable as to any claim, that claim (and only that claim) will proceed in court; the rest of this Section will remain in force.
Except for matters subject to arbitration, any court action will be filed exclusively in the state or federal courts located in Clark County, Nevada, except to the extent applicable consumer-protection law gives you the right to bring suit in your state of residence.
13. Changes to these Terms
We may update these Terms at any time. The "Effective date" reflects the most recent update. Continued use of the Site after a change constitutes acceptance of the updated Terms.
